GENERAL PURPOSE OF THE JOB: The Assistant General Counsel, Labor & Employment will serve as a key member of the Labor and Employment legal team. This position reports directly to the Assistant General Counsel, Labor and Employment. This teammate will represent DaVita Inc., the nation's leading private provider of kidney care services in the United States. DaVita Inc. operates ~1,500 outpatient kidney dialysis centers and provides related medical services primarily in dialysis centers and in contracted hospitals. Its services include outpatient dialysis services; hospital inpatient dialysis services; and ancillary services, such as ESRD laboratory services and disease management services. The company's subsidiary, DaVita Clinical Research, conducts renal and renal-related research trials of new drugs and devices. DaVita serves approximately 115,000 patients. The Assistant General Counsel is responsible for providing advice and guidance on a wide variety of labor and employment issues that arise from the day-to-day operations of a growing, complex public company operating in a heavily regulated environment. This position will also be responsible for managing employment-related litigation, including agency complaints. He/she will be part of a team that focus's on creating new strategies to support our teammates and drive efficiencies while ensuring that the Company leads the way in being the Partner and Employer of Choice. ESSENTIAL DUTIES AND RESPONSIBILITIES: The following duties and responsibilities generally reflect the expectations of this position but are not intended to be all inclusive.
Providing guidance to the Company, Senior Executives, and the Company's People Services team on the full gamut of employment, human resource and labor matters, including all policies and procedures. Overseeing labor and employment litigation where DaVita is a party, including managing costs to ensure effective use of resources. Investigating or overseeing the investigation of complaints by teammates concerning violations of company policies or related issues. Providing training to the Company's People Services team and/or managers on labor and employment legal issues. Advising senior management and DaVita business units on employment compliance and risk management in order to accomplish business objectives without undue risk. Keeping the Company's senior management abreast of significant labor and employment decisions, legislation and regulatory rulings that may affect the Company's business or policy. Developing a thorough understanding of and familiarity with the Companys business, its people, markets, facilities, customers and competitors in order to identify trends and formulate appropriate structures and strategies. Providing senior management and business units with advice, counseling and advocacy regarding labor matters. Drafting, reviewing, analyzing and negotiating employment-related agreements including consulting, severance, incentive, non-compete and confidentiality agreements. Establishing a rapport and working relationship with teammates at all levels in order to encourage and continue the proactive use of in-house legal counsel. Performing special assignments or projects. Must be able to travel a minimum of 25% (Education, licenses, certifications, and experience required to fulfill the essential duties, include computer skills as required): Strong alignment with DaVita's Mission and Core Values Unquestioned integrity and ethics in business and personal conduct. A proven track record of working well with, and influencing members of a senior management team. The ability to think like a business executive and facilitate management objectives, yet the willingness and ability to provide objective and independent assessments and advice and serve as a "hands-on" lawyer. The ability to handle a substantial workload, including multiple, concurrent projects, many involving time pressured situations. Demonstrated skill in translating into clear business terms and otherwise "demystifying" complex legal concepts for less legally sophisticated client groups. The experience and confidence to push for change and, when appropriate, to challenge the status quo, in a way that will be heard and respected. Emotional maturity, stature and strong interpersonal skills; one whose counsel and judgment are actively sought.
